## When internal resolution is not enough

If you have a concern about a vehicle recovery job — billing, workmanship, damage after handover, or communication — understanding **where** to escalate matters as much as **how**. In the United States and Canada, many consumer disputes are heard in **state or provincial small claims courts** (sometimes called limited civil courts or conciliation courts). Procedures, dollar limits, and filing fees vary by jurisdiction. This guide explains general principles, how EEK Mechanical's Terms of Service fit in, and practical steps after EEK's internal dispute process.

**Not legal advice.** Confirm court rules, deadlines, and limits for your state or province before filing.

## Guiding principles before you file

### Separate the questions

A complaint about **whether an agreed amount is owed**, about **EEK's own charges or process**, and about **workshop workmanship or post-handover damage** may involve different parties, legal tests, and remedies. Merging them in one filing increases the risk of naming the wrong defendant or choosing a court that cannot hear the claim.

### Name the correct respondent

Hands-on repair work is usually performed by a **contractor or workshop**, while EEK coordinates towing, dispatch, and billing. EEK's Terms draw that distinction (see §17.5 for supplier-related damage). Filing against the wrong party wastes time and may be dismissed.

### Complete EEK's internal process first

Terms require you to raise concerns through the [disputes portal](/disputes-tribunal) and receive a **formal written decision** before external escalation (§17.2–17.4). That record is important evidence if you later go to court.

### Document what you tried

Courts expect a short chronology: dates, what you asked for, responses received, and why disagreement remains — not only that you are unhappy or payment is late on an amount you already accepted.

## EEK Terms — Section 17 (summary)

- **§17.1:** Raise disputes at [disputes tribunal](/disputes-tribunal) or from your customer portal.

- **§17.2–17.3:** Internal review and a formal written decision on the job record.

- **§17.9:** If you are not satisfied with EEK's decision on EEK's charges or conduct, you may file in the small claims or limited civil court for your service location (limits vary by state or province). EEK may pay the filing fee when you use [dispute filing](/dispute-filing). The claimant bears the burden of proving excessive charging or breach.

- **§17.5:** Where alleged damage was caused by a supplier rather than EEK, EEK may assist you in pursuing the supplier, including filing-fee support as described in the Terms.

## Small claims basics (United States)

Each state sets its own small claims limit, filing fee, and rules about lawyers, appeals, and collection. Many states publish self-help guides (for example through state court websites or [usa.gov state consumer resources](https://www.usa.gov/state-consumer)). Typical themes:

- Informal hearings focused on documents and testimony

- Limits on claim size (often higher if both parties agree)

- Binding judgments that may be enforced through the court if not paid

State consumer protection laws (including UDAP-style statutes) and, where goods are involved, Article 2 of the UCC may also apply — but specific sections and remedies depend on your state.

## Evidence to gather

- EEK formal decision PDF (if issued)

- Invoices, receipts, and payment records

- Portal messages, emails, and call records referenced on your booking

- Workshop reports, tow records, and diagnostics

- Third-party mechanic opinions and photos

- Insurance or PI paperwork (blank and completed), if relevant
